Welcome to J’s Focus Group, a private financial education and discussion community hosted on Discord. Throughout these Terms of Service, “J’s Focus Group,” “the Group,” “the Service,” “the Community”, “we,” “us,” or “our” refer to the membership platform and its administrators. By accessing, subscribing to, or participating in the Group, you (“Member,” “you,” or “user”) agree to be bound by the following terms, policies, and conditions.

1. Educational Purpose Only

The content provided within this Discord server, including but not limited to messages, posts, videos, voice chats, files, and any other materials, is for educational, informational, and entertainment purposes only. Nothing shared should be interpreted as personalized financial, investment, legal, or tax advice.

2. No Financial Advice

The administrators, moderators, and contributors to this group are not licensed financial advisors, and no content provided shall be construed as investment recommendations. All discussions of trading strategies, asset allocations, or market commentary are shared from personal experience and should not be considered professional advice.

3. Individual Responsibility

By participating in this group, you agree that:

• You are solely responsible for your own financial decisions.

• You will perform your own due diligence before making any trades or investments.

• You will not hold any member of this group, including its creators and administrators, liable for any losses you may incur.

4. No Guarantees or Warranties

We make no representations or guarantees as to the accuracy, reliability, timeliness, or completeness of any information shared. Market conditions change rapidly, and past performance is not indicative of future results. We are not liable for any errors or omissions in any content shared.

5. Risk Disclosure

All forms of investing and trading involve substantial risk, including the risk of complete loss of capital. By participating, you acknowledge and accept that:

• Markets are unpredictable and speculative.

• There are no guaranteed returns.

• You may lose all or part of your invested capital.

• Past performance shown by any member, including administrators, is not indicative of future results.

• Individual results may vary significantly based on market conditions, experience, and execution.

• No guarantee of profitability is made or implied by participation in this community.

6. Billing, Payments & Refund Policy

6.1 Membership Fees & Access

Access to certain parts of this community may require a paid subscription or one-time fee. Fees will be clearly stated at the time of purchase. Access will be granted upon receipt of payment and is subject to these Terms of Service.

6.2 No Refund Policy

Our services operate on a strict "no refuns" policy for membership fees or any other fees and services provided by us. All payments are final. We do not offer refunds, partial refunds, or credits once access to the paid services has been granted. By purchasing, you acknowledge and agree that all digital content and access is considered delivered upon payment and login credentials or server access being provided.

6.3 Subscription Management

If you are on a recurring subscription, you are responsible for managing your membership. You may cancel at any time prior to your next billing cycle through the original payment platform (e.g., Stripe, LaunchPass). Canceling a subscription stops future charges but does not trigger a refund for the current or past billing periods.

In the event of a declined payment, expired card, insufficient funds, or any other billing issue that prevents the successful collection of subscription fees, we reserves the right to suspend, restrict, or revoke access to any and all paid services, features, or content until such time as the outstanding amount is successfully collected or the billing issue is otherwise resolved. We are under no obligation to provide access to paid content or services during any period in which payment is outstanding.

6.4 Chargebacks & Disputes

By joining and participating in the Focus Group By J discord, you acknowledge and agree that you will not initiate any chargeback or dispute of paymenth made to Focus Group By J.

If you are not satisfied with the services provided by Focus Group By J, you agree that the appropriate course of action is to cancel your membership och subsrciption.

You acknowledge that cancelling your membership or subscription is the method of resolving any dissatisfation with our services, and you will not seek a refund through chargebacks or disputes.

Initiating a chargeback or dispute without first attempting to resolve any concerns or issues with Focus Group By J may be concidered a breach of these Terms and Conditions and can result in the member's immediate removal and ban from the Discord group without refund.

We reserve the right to contest any chargeback or payment dispute and to report fraudulent activity to the relevant authorities and payment processors.

Please note that the "no refund" policy remains in effect, and you are not entitled to a refund of any previously paid membership fee or any other fees. By continuing to use the Focus Group By J services, you acknowledge and accept there terms regarding chargeback disputes, refunds, and resolution of dissatisfaction.

6.5 Modifications to Pricing

We reserve the right to modify pricing, billing terms, or offered services at any time. Members will be notified in advance if changes affect their current subscriptions.

7. Intellectual Property

All original content provided within this group, including strategies, presentations, templates, and educational materials, are the intellectual property of J's Focus Group. You agree not to record, share, distribute, copy, or reproduce any proprietary content without explicit written permission, which may be revoked at any time.

7.1 Ownership and Royalty-Free use of Discord posts

By posting any and all content, messages, or any other form of communication within the Focus Group By J discord or with any members, admins, moderators of Focus Group By J, you acknowledge and agree that Focus Group By J retains ownership of such content.

Focus Group By J and its owners is granted perpetual, irrevocable, royalty-free, non-exclusive, worldwide license, use, reproduce, modify, adapt, distribute, and display the content posted in the Discord server for any purpose.

8. Confidentiality & Community Rules

To maintain the integrity of this group:

• You agree to keep all group content private and not disclose internal discussions or shared materials to outsiders.

• You agree to respect all members, moderators, and administrators. Harassment, hate speech, spam, or any form of misconduct will result in immediate removal from the group without refund.

For detailed legal obligations regarding confidentiality and proprietary content, please review Section 13.

9. Legal & Tax Implications

You understand that all financial actions may have legal and tax consequences. Always consult with licensed professionals (lawyers, accountants, financial planners) regarding your personal situation.

10. Limitation of Liability

To the fullest extent permitted by law, we disclaim all liability for any direct or indirect loss, damage, or consequences arising from your participation in this group or reliance on any information provided herein.

11. Right to Remove, Suspend, or Ban Members

To maintain a secure, respectful, and professional community, we operate under a three-strike policy for most conduct-related violations. However, we expressly reserve the right to bypass the three-strike system and take immediate action without prior warning in cases involving serious misconduct.

11.1 Three-Strike Disciplinary Policy

Strike 1 – Initial Warning A private warning will be issued, outlining the rule(s) violated and expectations moving forward.

Strike 2 – Final Warning A second violation will result in a final warning. The member will be clearly informed that one more infraction will lead to removal without refund.

Strike 3 – Removal or Ban A third violation will result in immediate removal or permanent banning from the group. No refunds will be issued - We reserve the right to take legal action and seek recovery of damages where applicable

11.2 Immediate Removal Without Warning

We reserve the full right to immediately suspend, remove, or permanently ban any member without prior warning or refund if their behavior is deemed seriously harmful to the community, the service, or its ownership.

This includes, but is not limited to, situations where a member:

• Engages in harassment, hate speech, discriminatory remarks, or any form of threatening behavior toward other members or the team

• Records, shares, leaks, distributes, or resells any confidential, paid, or proprietary material from the group—without our explicit written permission—which shall be considered a material breach of these Terms

• Commits payment fraud, chargebacks, or disputes without valid basis after accessing content or interacting in the group

• Attempts to manipulate, scam, or exploit other members for financial or personal gain

• Promotes, advertises, or solicits other services, products, or communities without our explicit written approval

• Deliberately disrupts the learning environment, undermines group integrity, or damages the brand's operations or reputation in any way

These actions may result in permanent banning from the current and all future offerings by J's Focus Group, and, if necessary, we reserve the right to pursue legal action and recover damages where applicable.

11.3 Appeals

Members may request a review of their removal by submitting an appeal via email. We reserve the right to accept or deny any appeal at our sole discretion.

12. Access Restrictions

We reserve the right to restructure, make any content that was previously offered unavailable, aswell as limit, suspend, or terminate your access to the community, content, and services at any time, without prior notice or refund, if any of the following, but not limited to, actions are taken by you:

• Violate any part of these Terms of Service or the Confidentiality Agreement

• Fail to make timely payments, initiate a chargeback, or dispute a valid payment without resolving the issue

• Engage in conduct deemed harmful, disruptive, fraudulent, or damaging to the community or our business operations

By using our services, you acknowledge and accept that such actions may be taken at our sole discretion to protect the integrity and security of the group.

13. Confidentiality and Non-Disclosure

13.1 Confidentiality Agreement

By joining and participating in J's Focus Group (the "Community"), you agree to enter into a binding confidentiality agreement with the operator(s) of the Community and acknowledge that you will have access to proprietary and confidential information.

13.2 Definition of Confidential Information

"Confidential Information" includes, but is not limited to:

• All trading strategies, methodologies, systems, techniques, and proprietary approaches

• Specific trade setups, entry/exit criteria, risk management protocols, and timing strategies

• Market analysis, predictions, commentary, and proprietary indicators

• Educational materials, course content, training methodologies, and instructional frameworks

• Member discussions, questions, interactions, and community communications

• Performance data, results, statistics, and track records

• Any other proprietary information, content, or materials shared within the Community

Confidential Information does not include information that: (a) is or becomes publicly available through no breach by you; (b) was rightfully known to you prior to joining the Community; (c) is independently developed by you without use of or reference to any Confidential Information; or (d) is required to be disclosed by law or court order, provided you give reasonable advance notice to allow the Community to seek protective measures.

13.3 Competing Service Definition

"Competing Service" means any trading education service, mentorship program, signal service, investment advisory service, trading course, financial education business, or similar service that provides trading strategies, market analysis, or financial education, whether operated by you, through you, or by a third party with your involvement.

13.4 Confidentiality Obligations

You acknowledge the proprietary and confidential nature of all information shared within the Community and agree to maintain strict confidentiality. All Confidential Information is provided for your personal, private, non-commercial use only.

You specifically agree that you shall not:

• Distribute, publish, post, or communicate any Confidential Information to any third party through any medium, including social media, forums, messaging apps, or other trading communities

• Use any Confidential Information for the benefit of a Competing Service or to develop competing methodologies

• Reproduce, modify, reverse-engineer, or attempt to replicate the proprietary trading strategy or system with intent to selling it

• Share login credentials or allow others to access your account or view Community content

• Discuss, describe, or reference specific strategies, setups, or methodologies outside the Community, even in general terms

• Use Confidential Information to provide trading advice, mentorship, or education to others

Exception for Authorized Marketing Activities: The above restrictions do not apply to specific content and activities that have received prior written authorization from the Community operator(s) as detailed in Section 13.5.

13.5 Written Authorization for Marketing Activities

Certain members may be granted written authorization by the Community operator(s) to share specific Confidential Information for marketing purposes. Such authorization:

• Must be requested in writing and explicitly granted in writing before any sharing occurs

• Will specify exactly what content may be shared and through which channels

• May include specific requirements for attribution, disclaimers, or presentation format

• Can be revoked at any time with written notice

• Does not grant permission to share any content beyond what is specifically authorized

• Does not exempt the member from confidentiality obligations regarding all other Confidential Information

All marketing activities must comply with the specific terms of the written authorization. Sharing content beyond the scope of authorization or without proper authorization constitutes a material breach of this agreement.

13.6 Member Responsibility and Access Control

You are fully responsible for:

• Taking reasonable precautions to prevent unauthorized access to Confidential Information

• Immediately notifying the Community of any suspected breach or unauthorized disclosure

• Securing your devices and accounts used to access the Community

13.7 Acknowledgment and Confirmation

Before accessing advanced materials or strategy-specific content, you may be required to separately acknowledge your understanding of these confidentiality obligations. Your continued participation constitutes ongoing confirmation of your agreement to these terms.

13.8 Duration of Obligations

These confidentiality obligations apply during your membership and continue for a period of five (5) years after your access to the Community ends, regardless of the reason for termination.

13.9 Liquidated Damages

Given the proprietary nature of the trading strategy and the difficulty in calculating actual damages from unauthorized disclosure, you agree that any material breach of this confidentiality clause will result in liquidated damages of €10,000 per incident. This amount represents a reasonable estimate of potential harm and is in addition to, not in place of, injunctive relief and other available remedies.

13.10 Accidental Breach and Cure Period

If you accidentally breach these obligations, you must:

• Immediately notify the Community upon discovery

• Take all reasonable steps to minimize further disclosure

• Cooperate fully in any remedial actions

• Comply with any reasonable requests to mitigate harm

Failure to promptly notify or cooperate will be considered a material breach without opportunity to cure.

13.11 Remedies and Enforcement

You acknowledge that:

• Monetary damages may not be sufficient to remedy a breach of this clause

• The Community has the right to seek equitable relief, including injunctions and specific performance

• Any violation may result in immediate termination without refund

• The Community may pursue civil legal action for damages, injunctive relief, and recovery of legal costs

• The Community may use monitoring and detection methods to identify breaches

13.12 Cooperation with Investigations

You agree to cooperate fully with any investigation of suspected breaches, including providing information about potential violations by other members and assisting in enforcement actions.

13.13 Severability

If any provision of this confidentiality clause is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it enforceable.

13.14 Governing Law and Jurisdiction

This confidentiality clause is governed by and shall be construed in accordance with the laws of Sweden. Any dispute arising under or in connection with this clause shall be subject to the exclusive jurisdiction of Swedish courts.

13.15 Entire Agreement

This confidentiality clause, together with the complete Terms of Service, constitutes the entire agreement between you and the Community regarding confidentiality obligations and supersedes all prior negotiations, representations, or agreements relating to this subject matter.

14. Modification of Terms

We may update these Terms and Conditions, including the Confidentiality and Non-Disclosure provisions in Section 13, at any time. Continued participation in the group after changes implies acceptance of the revised terms. Changes to confidentiality obligations will apply to all Confidential Information accessed both before and after the modification date.

15. Data Protection and Third-Party Services

We do not directly collect or store personal data. However, our service providers (LaunchPass for membership management and Stripe for payment processing) collect and process personal information necessary for service delivery. By using our services, you acknowledge and agree to the privacy policies of these third-party providers. You are responsible for reviewing their respective privacy policies and terms of service.

16. Platform Dependencies and Third-Party Services

Our services are provided through Discord, a third-party platform, with membership management through LaunchPass and payment processing through Stripe. We do not control these platforms' operations, policies, or availability. Service interruptions, account suspensions, platform changes, or discontinuation of services by these third parties are beyond our control and do not constitute grounds for refunds or liability on our part. In the event that any third-party service becomes unavailable, we will make reasonable efforts to migrate to alternative platforms or provide substitute services, but we cannot guarantee uninterrupted access to our community.

17. Age Requirements

You must be at least 18 years old to participate in this community. By joining, you represent and warrant that you meet this age requirement. If you are under 18, you may only participate with explicit parental consent and supervision.

18. Force Majeure

We are not liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to technical failures, platform outages, natural disasters, or other unforeseeable events.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect, and the invalid provision will be modified to the minimum extent necessary to make it enforceable.

20. Governing Law and Jurisdiction

These Terms of Service are governed by and shall be construed in accordance with the laws of Sweden. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of Swedish courts. Before pursuing legal action, parties agree to attempt resolution through good faith negotiation. If negotiation fails, disputes may be resolved through binding arbitration under Swedish arbitration rules, unless otherwise prohibited by applicable law.

21. Inactive Account Policy

Members who remain inactive for extended periods while maintaining active subscriptions will retain their access rights according to their payment terms. However, we reserve the right to:

• Remove inactive members from active discussion channels after 90 days of inactivity to maintain community engagement

• Archive or remove accounts that have been inactive for more than 12 months, with 30 days advance notice via email

• Suspend access for accounts that pose security risks due to inactivity or compromised credentials

For one-time payment or lifetime access members, inactivity alone does not result in loss of access rights, but the security and archival provisions above still apply. Members may contact us to reactivate archived accounts, subject to identity verification.
